Terms and Conditions – LUX MADEIRA

1. The Contract

We recommend that you read all the following information carefully before proceeding. By making a booking, you confirm that you have read, understood, and accepted these Terms and Conditions and our Privacy Policy.

These Terms and Conditions apply to all individuals included in the booking. The services covered are those detailed in your booking confirmation invoice.

2. Booking and Pricing

2.1 Prices

a) Pricing – All prices listed are per passenger (for shared services), unless you opt for a private service, which will be priced per vehicle. All prices are net, per service, in euros, and include VAT where applicable, and only the features stated in each tour’s description.

b) Price changes – Prices displayed on our website reflect current rates and may be updated without prior notice. Once a booking is confirmed, no additional payment will be required if the price increases. Conversely, LUX MADEIRA does not provide refunds if the price subsequently decreases.

3. Exclusions

The price of your trip does not include:

  • Tips – Tipping is not mandatory, and our staff will not request or expect tips. However, if you are satisfied with the service provided, a small gesture of appreciation is welcomed and valued.

4. Changes and Cancellations

4.1 Cancellations by the Traveller

4.1.1. MULTI-DAY PACKAGES (HOTEL + TRANSFERS + TOURS)

Applies to all 3, 5 and 7-night holiday packages.

All cancellations are subject to a non-refundable administrative fee of €50 per person. This applies regardless of the date or reason for cancellation, except when 100% cancellation fees are charged.

Cancellation penalties apply as follows:

  • More than 30 days before arrival: refundable, less administrative charges
  • 15 to 29 days before arrival: 20% of the total package value, plus administrative charges
  • 7 to 14 days before arrival: 50% of the total package value, plus administrative charges
  • Less than 7 days before arrival, no-show or early departure: 100% of the total package value (no additional fees apply).

All cancellation requests must be submitted in writing (email). Refunds will be processed to the original payment method within 10 business days after written confirmation.

4.1.2. Tours and Transfers Only

All cancellations are subject to a non-refundable administrative fee of €10 per person, unless 100% cancellation fees apply.

  • More than 2 days before the tour or transfer: refundable, less administrative charges

  • 2 days before: 50% of the total value (administrative fee included)

  • 1 day before or no-show: 100% of the total value (no refund)

4.3 Cancellations by LUX MADEIRA

We reserve the right to cancel a tour due to unforeseen circumstances beyond our control. In such cases, you may choose between:

  • A full refund, or

  • Rescheduling for a later date.

4.4 Booking Changes by the Traveller

You may request changes by cancelling the original booking and making a new one. The price applicable will be the current rate at the time of the new booking, and cancellation fees may apply (see section 4.1).

Alternatively, contact LUX MADEIRA directly to request a change. Changes are subject to availability and our approval.

4.5 Amendments by LUX MADEIRA

We will make every effort to deliver services as described. However, due to local conditions or external factors, we reserve the right to change an itinerary without prior notice. We will inform you as early as possible if this happens.

5. Refund and Returns Policy

The Refund and Returns Policy forms an integral part of these Terms and Conditions and must be read together with them.

For withdrawal rights and specific cancellation timelines applicable to holiday packages, the conditions set out in the Refund and Returns Policy shall apply.

6. Confirmation and Purchase Order

a) Confirmation – Once we receive full payment, you will receive a confirmation email. If you do not receive it, please contact us.

b) Purchase order – You must present your booking confirmation (digital or printed) at the start of the tour.

7. Your LUX MADEIRA Tour

7.1 Traveller Confirmation

We recommend confirming the tour 24 hours before the scheduled departure by contacting LUX MADEIRA.

7.2 Punctuality

Please arrive at the designated meeting point on time. Late arrivals will be considered “no-shows” and are not eligible for a refund unless we receive prior notice. If we are delayed, we will leave a message at your hotel reception.

7.3 Traveller Conduct

All travellers are expected to behave respectfully and responsibly. Any individual whose behaviour is unsafe, disruptive or offensive may be removed from the tour without refund. All participants must comply with the laws and customs of Portugal.

8. Personal Details

You are responsible for providing accurate information when booking, including:

  • Full names of all travellers

  • Hotel or pickup location

  • Flight number (for transfers)

  • Email and phone contact details

9. Age and Health Requirements

a) Age – Travellers under 16 must be accompanied by an adult.
b) Health – You are responsible for ensuring that you are fit to participate in the chosen activity.

10. Tour Authority

All tours are led by an authorised group leader. The leader’s decisions regarding safety, conduct, and logistics are final. Failure to comply may result in removal from the tour without refund. LUX MADEIRA may also bar participation in future tours.

11. Travel Insurance

All travellers must have valid travel insurance covering medical, personal liability, and cancellation risks. LUX MADEIRA and its partners are not responsible for costs or losses due to inadequate insurance.

Tip: Bring your European Health Insurance Card and carry it at all times.

12. Complaints

If you have a complaint, please raise it with your tour leader or contact LUX MADEIRA immediately. We cannot resolve issues reported only after the tour has ended.

The designation “LUX MADEIRA .COM” is a registered mixed trademark under Portuguese law (INPI registration no. 690776), protected by the Portuguese Industrial Property Code.

15. Modifications to These Terms

LUX MADEIRA reserves the right to modify these Terms and Conditions at any time. Any changes will be published on our website and will apply from the date of publication.

16. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Portugal. In the event of any dispute, the courts of the District of Funchal shall have exclusive jurisdiction, unless otherwise stipulated by mandatory consumer protection laws.
